1. General Provisions
1.1. These Terms and Conditions govern all agreements for the provision of services by Omniscient Research (“the Company” or “the Supplier”) to any customer (“the Client”), and they take precedence over any conflicting terms proposed by the Client.
1.2. Any modifications to these Terms shall only be valid if confirmed in writing by Omniscient Research.
2. Pricing and Payment Terms
2.1. Payments must be completed in full using accepted methods such as bank transfers, credit cards, digital wallets, cheques, or authorized payment gateways prior to service delivery.
2.2. All deliverables will be provided electronically to the Client.
2.3. Omniscient Research retains the right to revise service offerings, introduce promotional offers, or make updates at any time.
2.4. While the Supplier may update pricing for future services, the quoted price will remain unchanged once an order is placed and confirmed by the Client.
3. Responsibilities of the Client
3.1. The Client agrees to collaborate with Omniscient Research as needed to enable effective service delivery.
3.2. The Client shall provide all reasonably requested information to facilitate the provision of services.
3.3. The Client must keep their contact information—including full name, address, telephone number, fax, and email—accurate and up to date.
3.4. The Client is responsible for complying with applicable laws, especially those concerning confidentiality and data protection.
4. Responsibilities of the Supplier
4.1. Omniscient Research commits to delivering services with due skill, professionalism, and in alignment with industry best practices.
4.2. Standard delivery of market survey materials will be completed within 24 hours of full payment, unless otherwise agreed under a separate contract or service level agreement.
5. Limitation of Liability
5.1. The Company’s liability for any direct losses due to negligence, breach of contract, or otherwise shall not exceed the total amount paid by the Client for the specific service.
5.2. Under no circumstances shall Omniscient Research be liable for indirect, incidental, or consequential losses—including loss of profit—arising from its services.
6. Refund, Cancellation, and Return Policy
Omniscient Research offers its products and services in the form of syndicate market research reports, consulting assignments, and custom research. All the products and services contain the critical market information that is sold/delivered in electronic, downloadable form. Hence, the products and services once purchased would be deemed final and there would be no refund issued owing to the nature of products & services. No cancellation will be accepted after the payment is done.
7. Force Majeure
Neither party shall be held liable for any delay or failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, labor disputes, warfare, fires, supply chain disruptions, or other unforeseen events. A reasonable extension of time shall be granted in such cases.
8. Intellectual Property Rights
All materials delivered by Omniscient Research—including reports, proposals, survey instruments, brochures, and samples—are for the Client’s use only in the format provided. Reproduction, distribution, or adaptation in any form is strictly prohibited without prior written consent.
9. Governing Law
These Terms and Conditions shall be interpreted and enforced in accordance with the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of India.
